What is the legal basis for processing personal data?

The legal basis for the processing of personal data is in particular § 6 para. 1 lit. e GDPR in conjunction with § 14 para. 1 Act on the Autonomy of Institutions of Higher Education in the Free State of Saxony (SächsHSFG) and the provisions of the Saxon Regulations on the Data Protection of University Personnel (SächsHSPersDatVO) applicable to the respective processing purpose. In addition to the aforementioned regulations, the regulations of TU Dresden (regulations for enrolment, study, examination and doctoral regulations, etc.) apply. Which personal data is processed?

Without the consent of the data subjects, only the data specified in § 2 to § 18 of the Saxon Regulations on the Data Protection of University Personnel (SächsHSPersDatVO) are processed.

How long is personal data processed/stored?

The storage periods are based on § 18 of the Saxon Regulations on the Data Protection of University Personnel (SächsHSPersDatVO).

Is personal data transmitted to third parties?

Insofar as this is not otherwise legally or juridically permissible (e.g. data transfer to other public bodies on the basis of § 6 para. 1 sentence 2 of the Saxon Data Protection Implementation Act (SächsDSDG) or § 199a of the Social Code - Book V - Statutory Health Insurance (SGB V)), no personal data is transferred to third parties.

What are the basic rights of data subjects?

In order to claim the rights, a notification in text form (letter or email) to the responsible person is sufficient.

Right to Information (§ 15 GDPR)

Data subjects have the right to obtain at any time information on the data processed concerning their person and the possible recipients of their data.

Right to Correction, Deletion and Limitation (§ 16 – 18 GDPR)

Data subjects may request that TU Dresden correct or delete their personal data or limit its processing at any time.

Right of appeal (§ 77 GDPR)

Data subjects can contact the data protection officer of TU Dresden at any time and, in case of a complaint pertaining to §. 77 GDPR, the responsible supervisory authority for data protection.
